&ldquo;The learned trial judge did not fairly evaluate the defence and wrongly treated it as a mere denial,&rdquo; she said. &ldquo;There was no element of dishonesty when Syed Saddiq instructed his staff to withdraw party funds, as he was legally entitled to do so at the time.&rdquo;
The court ruled that the prosecution had failed to prove the core elements of the offences, particularly the intent required for criminal breach of trust (CBT), misappropriation, and money laundering. According to the judgment, the failure to properly direct the trial and the misinterpretation of legal standards warranted full appellate intervention.
The Charges and What They Meant
Syed Saddiq, 32, had been convicted in 2023 on four charges:

The money laundering convictions would have added an additional two years, running concurrently. Syed Saddiq&rsquo;s sentence also included two strokes of the rotan and a RM10 million fine. The sentence had been stayed pending the appeal.
